GENERAL CONDITIONS OF SALE FOR E-COMMERCE

In light of Legislative Decree no. 21 of 21 February 2014, which transposed Directive 2011/83/EU.

The offer and sale of products on the website www.lucedisorrento.it are governed by these General Conditions of Sale, which comply with the provisions of Legislative Decree No. 206/2005 (Consumer Code), as amended. Before placing an order, the Customer is required to carefully read the following General Conditions of Sale; placing an order implies full knowledge and acceptance of both the General Conditions of Sale and the information contained in the Order Form.

Once the online purchase procedure has been completed, the Customer is required to print and keep the General Conditions of Sale and the Order Form.

The General Conditions of Sale concern the sale of products carried out online via the e-commerce service on the website www.lucedisorrento.it

The products are sold to the Customer identified by the data entered when completing and sending the Order Form in electronic format.

3. PRODUCT AVAILABILITY

Product availability refers to the availability at the time the Customer consults the site and the product sheet, which must be considered merely indicative because, due to the simultaneous presence of other users on the site, the products could be sold to others before the order is confirmed.

Even after Nature Health Lab sends the order confirmation email, there may be cases of partial or total unavailability of the product. In this case, the Customer will be promptly informed by Nature Health Lab and can decide whether to accept delivery of only the available products or request cancellation of the entire order by communicating this via email.

4. PRICES

All product prices displayed and indicated on the website www.lucedisorrento.it are expressed in euros and include VAT. Shipping costs are not included in the purchase price but are indicated and calculated at the end of the purchase process before payment is made.

5. ORDERING PRODUCTS

The essential characteristics and prices of the products are shown in the offer relating to each product.

Nature Health Lab strives to describe and present the items sold on the website www.lucedisorrento.it as accurately as possible. However, errors, inaccuracies, and/or small differences between the website and the actual product may occur. The product photographs on the website www.lucedisorrento.it do not constitute a contractual element, as they are merely illustrative and representative.

To purchase products, the Customer must complete and send the electronic Order Form to Nature Health Lab following the instructions on the website. The Customer must place the product in the cart and, after reviewing the General Terms and Conditions, particularly regarding delivery costs and the terms and conditions for exercising the right of withdrawal and the Privacy Policy, must select the desired payment method and click "Submit Order."

By submitting the order, the Customer acknowledges and declares that he has read all the information provided during the purchase procedure and fully accepts the General Conditions of Sale.

Nature Health Lab reserves the right to evaluate the acceptance of orders received. Nature Health Lab will notify the Customer if it is unable to accept the order within 48 hours of the business day following the day the Customer placed the order with Nature Health Lab and will refund any fees already paid by the Customer.

6. CONCLUSION AND EFFECTIVENESS OF THE CONTRACT

The sale is considered concluded when Nature Health Lab sends the Customer an order confirmation email. The email contains the customer and order details, the price of the purchased goods, shipping costs, and the shipping address to which the goods will be sent.

Nature Health Lab undertakes to deliver the goods within 60 days from the day following the order confirmation.

7. PAYMENT METHODS

To ensure maximum security for its customers, Nature Health Lab relies on the expertise of PayPal and Nexi to handle all transactions. PayPal is one of the leading escrow services, specializing in e-commerce payments. Payment security is guaranteed by PayPal, and transactions are processed on a secure server.

During payment, you will be temporarily transferred to the PayPal website to fill out the necessary information for the transaction in complete safety.
On the PayPal website, payment can be made in two ways:
a) Visa or Mastercard credit card (no registration for PayPal services is required)
b) PayPal (a PayPal account is required)

By filling in the appropriate space, the Customer authorizes Nature Health Lab to charge the total amount of the Order to the credit card or PayPal account indicated.
Once payment is complete, you will be redirected back to the site to view your order summary.

8. DELIVERY METHODS

For each order placed on the website www.lucedisorrento.it, Nature Health Lab issues an invoice for the shipped goods. The invoice is issued based on the information provided by the customer at the time of ordering. No changes can be made to the invoice after it has been issued.

Shipping costs are the responsibility of the Customer, except for any applicable shipping charges, which are explicitly highlighted when placing the order. Payment for the goods will be made using the method chosen when placing the order. The Customer owes nothing more than the order total.

Nature Health Lab cannot be held responsible for any delays in delivery of the order.

Delivery of the ordered items is intended to be at street level except:
• different communication from our customer service
• as provided for in the product technical data sheet
• the explicit purchase of delivery to the floor, where applicable

Upon delivery of the goods by the courier, the Customer is required to check that the packaging is intact, not damaged, not wet or otherwise altered, including the sealing materials (adhesive tape or metal strapping).

Any damage to the packaging and/or product, or any discrepancy in the number of packages or information, must be immediately reported by writing a WRITTEN RESERVATION OF INSPECTION (SPECIFYING THE REASON FOR THE RESERVATION, e.g., "punctured packaging," "crushed packaging," etc.) on the courier's delivery receipt. Once the courier's document has been signed, the Customer will no longer be able to raise any objections regarding the external characteristics of the delivered goods.

If the material stored at the courier's warehouse is not collected within 5 working days due to repeated failure to deliver to the address indicated by the Customer when ordering, the order will be returned to the Nature Health Lab warehouses and the Customer will be charged the storage costs charged by the courier.

9. RIGHT OF WITHDRAWAL

The Buyer has the right to withdraw from the Contract , without penalty and without specifying the reason, within 14 calendar days (fourteen days) from the day on which the Buyer acquires physical possession of the goods. Only intact, sealed goods with the appropriate labels will be accepted.

The right of withdrawal is exercised by communicating with the Seller via the email address shop@lucedisorrento.it Customer service will open the return procedure.

The Buyer must return the goods without delay and, in any case, within 14 days (fourteen days) from the date the notice of withdrawal is sent to the Seller . The Buyer is responsible for only the costs incurred in returning the goods to the Seller. Every precaution must be taken when shipping the goods, using the original packaging and wrapping, or equivalent, to preserve their integrity and adequately protect them during transport. Returns following the exercise of the right of withdrawal must be made to the following address:

Once the products have been received, the Seller will initiate the refund procedure if and only if the products have been sent within the established deadlines (the postmark or the date of delivery to a courier, if applicable, will serve as proof of this date) and if the products are perfectly intact and in their original packaging complete in all its parts (product packaging and accessory documentation) and repackaged in conditions suitable for being put back on sale.

The Seller will refund the price of the item for which the right of withdrawal has been exercised within 14 days (fourteen days) of receiving the Buyer 's notice of withdrawal. Generally, the Seller will use the same payment method chosen by the Buyer for the initial transaction, unless the Buyer has specified otherwise; in this case, any additional costs resulting from the different payment method chosen will be the sole responsibility of the Buyer . The Seller reserves the right to withhold the refund until the item is received, or until the Buyer has provided proof of having returned it.

If the returned item is damaged or shows signs of wear and tear resulting from unnecessary use, the Seller will deduct from the refund an amount corresponding to the decrease in value, which may be equal to the full value of the item. Therefore, if the returned item is damaged (for example, abrasions, nicks, scratches, or other deformations, etc.), or is missing all parts or accessories ( including labels, tags, etc.), is not accompanied by the accompanying instructions/notes/manuals, original (or otherwise adequate) packaging and/or packaging, or the relevant warranty certificates (if any), or is opened (even if unused), the Buyer will be liable for the decrease in value of the item and will be entitled to a refund equal to the item's residual value.

Once the Seller has received the communication from the Buyer expressing his/her intention to exercise the right of withdrawal, all obligations connected to the Contract will cease, except as provided for in this Article.

10. WARRANTIES

For all products on the www.lucedisorrento.it website, purchased by a Consumer Customer, i.e. a natural person acting for purposes outside of their business or commercial activity, the warranty is valid provided that both of the following conditions are met:
- the defect occurs within 24 months of the date of delivery of the product;
- the customer must file a complaint within 2 months of the date on which the defect was discovered.

In the event of a lack of conformity, Nature Health Lab will, at no cost to the Customer, restore the product's conformity through repair/replacement or a price reduction, up to the termination of the contract with consequent refund of the price.

The Customer will be provided with a Product Return Authorization (ARP) number which must be indicated on the outside of the packaging, following the instructions provided directly in the relevant authorization email.

11. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

The website www.lucedisorrento.it, as well as all trademarks and distinctive signs used by Nature Health Lab in connection with the sale of products, is protected by applicable intellectual and industrial property rights. Any reproduction, communication, distribution, publication, alteration, or transformation, in any form and for any purpose, of the contents of the website, the trademarks, and distinctive signs used by Nature Health Lab (such as, by way of example, works, images, photographs, drawings, dialogues, presentations, music, sounds, videos, graphics, colors, functionality, and design of the website) is prohibited.

12. APPLICABLE LAW AND JURISDICTION

The sales contract between the Customer and Nature Health Lab is deemed to have been concluded in Italy and is governed by Italian law. Any dispute arising from the conclusion of this distance selling contract shall be subject to the exclusive jurisdiction of the Court of Brescia, excluding any competing or alternative jurisdictions.
